1. Introduction

These Terms of Service (“Terms”) govern your access to and use of the Itomixer / MyInteractive mobile application, websites and related services (collectively, the “Service”), provided by MyInteractive Technology AS (“MyInteractive”, “we”, “us”, or “our”).

By creating an account, accessing or using the Service, you agree to these Terms. If you do not agree to these Terms, you should not use the Service.

2. The Service

MyInteractive provides technology for interactive media experiences.

Depending on the features and content available, users may be able to listen to or view media, interact with audio and video, record new audio or video, create new layers or versions, participate in educational experiences, collaborate with others, and create or share user-generated content.

Features and functionality may change or develop over time.

3. User Accounts

Some features of the Service require a user account.

You agree to provide accurate information and to take reasonable steps to protect access to your account.

You are responsible for activity performed through your account unless such activity results from circumstances outside your reasonable control.

You must notify us if you believe your account has been compromised or accessed without authorisation.

4. User Content

“User Content” includes audio, video, recordings, performances, text, images and other material that you create, record, upload or submit through the Service.

As between you and MyInteractive, you retain ownership of your original User Content, subject to any rights in underlying music, recordings, films, images or other material owned by third parties.

You grant MyInteractive a limited, non-exclusive licence to host, store, process, reproduce, transmit and otherwise technically use your User Content only as reasonably necessary to operate and provide the Service and the functionality requested by you.

This licence does not transfer ownership of your User Content to MyInteractive.

5. Existing and Licensed Media

The Service may contain music, audio, video, films, educational material or other content owned or licensed by MyInteractive, artists, producers, publishers, record companies, filmmakers, content providers or other rights holders.

Using the Service does not transfer ownership of such underlying content to the user.

Permissions to remix, record with, modify, share or otherwise interact with particular content may vary according to the rights granted for that content and the functionality made available within the Service.

Users may only use such content in ways permitted by the Service.

6. Interactive Creations

One purpose of the Service is to enable users to interact creatively with existing media.

Where permitted, users may create personal performances, recordings, mixes, collaborative works or other interactive versions.

The creation of a user contribution does not remove, replace or otherwise affect the rights of the owner of the original underlying content.

Rights in an interactive creation may therefore include both rights in the user's original contribution and separate rights in the underlying material.

7. Sharing and Collaboration

Some features may allow users to collaborate with other users or share User Content.

You control whether to use such features where they are offered.

By choosing to share content with other users, you authorise the Service to process and make that content available as necessary to perform the sharing or collaboration requested by you.

You must have the necessary rights and permissions for material you choose to record, upload or share.

8. Acceptable Use

You may not use the Service to:

• violate applicable law;
• infringe copyright, privacy or other rights;
• upload or distribute content you do not have permission to use;
• harass, threaten, exploit or harm another person;
• distribute malware or other harmful software;
• attempt unauthorised access to accounts, systems or data;
• interfere with the operation or security of the Service;
• impersonate another person or organisation;
• use the Service for fraudulent or unlawful purposes; or
• encourage or assist others in any of the above activities.

We may restrict or remove content or suspend access where reasonably necessary to protect users, rights holders, MyInteractive, the Service or applicable legal requirements.

9. Intellectual Property

The Service, including its software, technology, design, interfaces, trademarks and associated intellectual property, is owned by or licensed to MyInteractive Technology AS and its licensors.

Except for rights expressly granted through the Service, no intellectual property rights are transferred to users under these Terms.

10. Privacy

Our collection and processing of personal information is described in our Privacy Policy.

11. Third-Party Services

The Service may integrate with third-party services, including authentication providers and technical service providers.

Your use of third-party services may also be subject to the terms and privacy policies of those providers.

12. Account Termination and Deletion

You may stop using the Service at any time.

Where an account is provided, you may request permanent account deletion using the deletion functionality or process provided by the Service.

Account deletion may permanently remove projects, recordings, User Content and other data associated with your account.

We may suspend or terminate access where there is a serious or repeated violation of these Terms, unlawful activity, security risk or other legitimate reason.

13. Service Availability

We aim to provide a reliable Service but cannot guarantee that the Service will always be available without interruption or error.

Features may be modified, updated or discontinued where reasonably necessary for technical, commercial, security, legal or operational reasons.

14. Disclaimer and Limitation of Liability

Nothing in these Terms excludes or limits rights or remedies that cannot lawfully be excluded or limited under applicable consumer law.

To the extent permitted by applicable law, MyInteractive is not responsible for indirect or consequential losses resulting from circumstances outside our reasonable control or from misuse of the Service.

15. Changes to These Terms

We may update these Terms to reflect changes to the Service, applicable law, technology or operational requirements.

The current version will be published on our website with its effective or last-updated date.

If changes materially affect users' rights, we will provide appropriate notice where required.

16. Governing Law

These Terms are governed by the laws of Norway, subject to mandatory consumer protection rights that may apply in the country where the user resides.
